Election Day for the upcoming General Election is Tuesday, November 3, 2020, and the polls will be open from 7a.m. to 8 p.m. If you do not have sufficient time outside of your working hours to vote at this Statewide election, you may, without loss of pay, take off enough working time to enable you to vote.
However, no more than two hours off for voting shall be without loss of pay. The time off for voting shall be only at the beginning or at the end of your regular working shift, whichever allows the most free time for voting and the least time off from the regular working shift, unless otherwise mutually agreed.
Employees are required to give their department at least two days’ notice if they want time off to vote. Time taken should be recorded as ATO.
Paid Time Off for Voting on Election Day
The California Election Code Section 14000 allows employees who do not have sufficient time outside of working hours to vote at a statewide election to take up to two (2) hours of time off for voting without loss of pay.
Paid Time Off – Precinct Election Board
Government Code Section 19844.7, California Code of Regulations, title 2, section 599.930, and most bargaining unit contracts allows an employee appointed as a member of a Precinct Board (Poll Worker) to take time off to serve as a member of a Precinct Board. The employee shall receive their regular salary and any fee paid by the Registrar of Voters for such services.
If you have any questions regarding time off to vote, please e-mail the DOR Transactions Unit at PayrollTransactions@dor.ca.gov.
